Terms of service
Welcome to Chedz™. These Terms of Service govern your use of shop.chedzsnacks.com (the "Site") and your purchase of Chedz™ products. The Site is operated by This Silly Girl's Kitchen ("we," "us," or "our") in connection with Hall Brands LLC, the owner of the Chedz™ brand. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Eligibility
To place an order, you must be at least 18 years of age and capable of entering into a binding contract in your jurisdiction. By placing an order, you represent that you meet these requirements.
The Site and Brand
The Chedz™ brand, trademarks, recipes, and associated intellectual property are owned by Hall Brands LLC and operated on the Site under license. All content on the Site, including text, images, product descriptions, and design, is the property of Hall Brands LLC or This Silly Girl's Kitchen, as applicable, or licensed for our use, and is protected by United States and international copyright and trademark laws. You may not reproduce, distribute, modify, or otherwise use any content from the Site without our prior written permission, except for personal, non-commercial use.
Customer Accounts
If you create a customer account on the Site, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at jason@thissillygirlskitchen.com if you suspect any unauthorized use.
Products and Pricing
We make every effort to display Chedz products and pricing accurately. However, we reserve the right to correct any errors in product descriptions, images, or pricing without prior notice. If a pricing error is discovered after an order is placed, we will contact you with the correct price before processing the order and allow you to cancel for a full refund if you do not wish to proceed.
Product availability is not guaranteed and is subject to production capacity, preorder demand, and inventory.
Preorders
Chedz is currently launching through a preorder model. Placing a preorder authorizes us to charge your payment method at the time of order. Production for each Chedz batch is triggered when we reach the production threshold for the batch.
Once the production threshold is met and we issue a production confirmation, your order becomes non-cancellable because we have committed to production with our manufacturer. If the production threshold is not reached within the preorder window, all preorders in that window will be automatically refunded to the original payment method in full.
Estimated shipping windows for preorders are best estimates and are not guaranteed delivery dates. We will communicate honestly with you about timing.
Orders, Payment, and Acceptance
All orders placed through the Site are offers to purchase, subject to our acceptance. We reserve the right to refuse or cancel any order at our discretion, including for reasons such as suspected fraud, inability to verify shipping address, or product availability. If your order is canceled by us, you will receive a full refund.
Payment is processed at the time of order placement through Shopify Payments or another integrated payment provider. You represent that you are authorized to use the payment method provided.
Shipping
Shipping terms, timelines, and costs are described in our Shipping Policy, which is incorporated into these Terms by reference. We ship within the United States only at this time.
Returns and Refunds
Returns and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms by reference. Because Chedz is a food product, physical returns are limited as described in that policy.
Health, Allergens, and Dietary Information
Chedz products contain cheddar cheese and may contain wheat depending on the SKU. Full ingredient and allergen information is available on each product page and on our standalone Ingredients and Allergens page. You are responsible for reviewing ingredient and allergen information before placing an order.
If you have a known food allergy, medical condition, or dietary restriction, consult a qualified healthcare provider before consuming any Chedz product. We are not responsible for adverse reactions resulting from failure to review ingredient information.
User Submissions
If you submit any reviews, comments, photos, or other content through the Site or to us directly, you grant This Silly Girl's Kitchen and Hall Brands LLC a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display that content in connection with the Chedz brand. You represent that any content you submit is yours to share and does not violate the rights of any third party.
Disclaimers
The Site and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Limitation of Liability
To the fullest extent permitted by law, This Silly Girl's Kitchen, Hall Brands LLC, and their respective officers, employees, members, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or products, including lost profits, lost data, or business interruption. Our total liability for any claim arising out of or related to these Terms or the Site will not exceed the amount you paid for the product giving rise to the claim. This limitation does not apply to liability that cannot be limited or excluded under applicable law.
Indemnification
You agree to indemnify and hold harmless This Silly Girl's Kitchen, Hall Brands LLC, and their respective officers, employees, members, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any applicable law or third-party rights.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Site will be resolved in the state or federal courts located in the State of Arizona, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. The most current version will be posted on the Site with a revised effective date. Continued use of the Site after changes constitutes acceptance of the updated Terms.
